1. Agreement to Terms

Welcome to Image1! These Terms of Service ("Terms") constitute a legal agreement between you and the Image1 team regarding your use of the Image1 mobile application (the "App") and related services.

By downloading, installing, or using our App, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use our App.

1.1 Eligibility

• Age Requirement: You must be at least 4 years old to use this App
• Parental Consent: Users under 13 require parental consent (COPPA compliance)
• Legal Capacity: You must have the legal capacity to enter into binding agreements
• Geographic Restrictions: Available worldwide where Apple App Store operates

2. Description of Service

Image1 is an AI-powered mobile application that transforms your photos into stylized artwork using advanced artificial intelligence technology. Our service includes:

• Image Transformation: AI-powered conversion of your photos into artistic styles
• Style Presets: Pre-designed artistic styles and filters
• Credit System: Usage-based system with free daily allowances and premium options
• Gallery: Personal storage and management of generated images
• Subscription Service: Premium features and enhanced credits

2.1 Service Availability

We provide our service on a "best effort" basis without guarantees of uptime or availability. We may modify, suspend, or discontinue the service with reasonable notice when possible.

3. User Accounts & Authentication

3.1 Account Creation

To use our App, you must create an account using Apple Sign-In. By creating an account, you agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

3.2 Account Termination

You may delete your account at any time through the App settings. We may suspend or terminate your account for violations of these Terms, illegal activity, or other reasons at our sole discretion.

4. Subscription & Payment Terms

4.1 Subscription Plans

4.2 Credit Packs

• 30 Credits: $4.99 - Premium credits with no watermark
• 100 Credits: $14.99 - Premium credits with 10% savings

4.3 Free Tier

• Daily Credits: 3 free credits daily (reset at 00:05 local time)
• Ad Rewards: Up to 4 additional credits via rewarded videos
• Watermark: Applied to free tier generations
• Resolution: Limited to 1024×1024 maximum

4.4 Payment Processing

• All payments are processed through Apple's App Store
• Subscription charges are recurring and automatic
• Prices are subject to change with 30 days notice
• All prices include applicable taxes

4.5 Billing & Renewal

• Subscriptions automatically renew unless cancelled 24 hours before renewal
• Your account will be charged within 24 hours prior to the end of the current period
• Manage subscriptions through your Apple ID account settings

5. Refund Policy

5.1 Subscription Refunds

Subscription refunds are governed by Apple's refund policy. To request a refund:

• Visit reportaproblem.apple.com
• Sign in with your Apple ID
• Find your purchase and request a refund
• Apple will review your request according to their policies

5.2 Credit Pack Refunds

Credit packs are generally not refundable once purchased and credits are added to your account. However, we may provide refunds in the following circumstances:

• Technical Failures: Automatic credit refunds for failed image generations
• Billing Errors: Incorrect charges or duplicate transactions
• Service Issues: Significant service disruptions beyond your control

5.3 No Refunds Policy

No refunds will be provided for:

• Content policy violations or inappropriate content submissions
• User dissatisfaction with generated image results
• Credits used for successful image generations
• Account termination due to Terms violations

6. Content Ownership & Intellectual Property

6.1 Your Generated Content

You own all generated images completely. This includes:

• Full Ownership: Complete rights to all images generated using our App
• Commercial Use: Freely permitted for all generated content
• No Platform Claims: We make no claim to your generated images
• Distribution Rights: You may distribute, sell, or license your generated images

6.2 Platform Intellectual Property

The App, including its original content, features, and functionality, is owned by the Image1 team and is protected by:

• International copyright laws
• Trademark protections
• Patent and trade secret laws
• Other intellectual property rights

6.3 Limited License to Use

We grant you a limited, non-exclusive, non-transferable license to use our App for personal and commercial purposes, subject to these Terms.

7. Prohibited Content & Conduct

7.1 Content Restrictions

You may not upload, create, or attempt to generate content that:

• Illegal Content: Violates any applicable laws or regulations
• Harmful Content: Promotes violence, harassment, or discrimination
• Adult Content: Contains nudity, sexual content, or adult themes
• Infringing Content: Violates third-party intellectual property rights
• Misleading Content: Contains false, deceptive, or misleading information
• Privacy Violations: Includes private information of others without consent

7.2 OpenAI Policy Compliance

All content must comply with OpenAI's usage policies and content guidelines. Content that violates these policies will be automatically blocked.

7.3 Prohibited Conduct

• Attempting to reverse engineer or hack the App
• Using automated systems to access the service
• Circumventing technical limitations or restrictions
• Sharing account credentials or selling access
• Engaging in any activity that damages or overloads our systems

8. Content Moderation & Enforcement

8.1 Automated Moderation

We use automated systems, including OpenAI's moderation API, to detect and prevent prohibited content before processing.

8.2 Manual Review

Flagged content may be subject to review. We may block prohibited content, suspend accounts for violations, and report illegal content to authorities when required by law.

9. Privacy & Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

9.1 Data Processing

By using our App, you consent to:

• Collection and processing of your data as described in our Privacy Policy
• Transfer of your data to third-party services (OpenAI, Firebase, etc.)
• International data transfers as necessary for service provision

9.2 Data Retention

We retain your data in accordance with our Privacy Policy and applicable laws. You may request data deletion by contacting us or deleting your account.

10. Disclaimers & Limitation of Liability

10.1 Service Disclaimers

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We specifically disclaim:

• Service Availability: No guarantee of uptime or uninterrupted access
• AI Accuracy: No guarantee of generated image quality or accuracy
• Content Suitability: No warranty that generated content meets your needs
• Technical Issues: No guarantee against bugs, errors, or technical problems

10.2 Limitation of Liability

To the maximum extent permitted by law:

• Damage Limitation: Our liability is limited to the amount you paid in the last 12 months
• Indirect Damages: We are not liable for indirect, incidental, or consequential damages
• Business Losses: No liability for lost profits, revenue, or business opportunities
• Data Loss: No liability for loss of data or generated content

11. Dispute Resolution

11.1 Governing Law

These Terms are governed by the laws of Cyprus, without regard to conflict of law principles. Any disputes will be resolved in Cyprus courts.

11.2 Individual Disputes

Class Action Waiver: You agree to resolve disputes individually and waive the right to participate in class actions, collective arbitrations, or other group proceedings.

11.3 Arbitration Option

As an alternative to court proceedings, disputes may be resolved through binding arbitration in Cyprus under Cyprus arbitration law.

11.4 Informal Resolution

Before pursuing formal legal action, please contact us at support@image1.app to attempt informal resolution.

12. Termination

12.1 User Termination

You may terminate your account at any time by:

• Deleting your account through App settings
• Contacting us at support@image1.app
• Canceling your subscription through Apple

12.2 Service Termination

We may terminate or suspend your access for:

• Violation of these Terms
• Illegal activity or abuse
• Extended inactivity
• Business reasons with advance notice

12.3 Effect of Termination

Upon termination:

• Your access to the App will be immediately revoked
• Your data will be deleted according to our retention policy
• Outstanding subscription periods will continue until expiration
• These Terms will survive termination where applicable

13. Changes to Terms

13.1 Modification Rights

We reserve the right to modify these Terms at any time. When we make material changes:

• Advance Notice: 30 days notice for material changes
• Notification Method: In-app notification and email
• Effective Date: Changes effective after notice period
• Continued Use: Constitutes acceptance of changes

13.2 Disagreement with Changes

If you disagree with modified Terms, you must stop using the App and may delete your account before the changes take effect.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Image1 regarding the App.

14.2 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in full force and effect.

14.3 No Waiver

Our failure to enforce any provision does not constitute a waiver of that provision or any other provision.

14.4 Assignment

You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.

14.5 Language

These Terms are written in English. Any translations are provided for convenience only, and the English version prevails in case of conflicts.
